1. Terms and Conditions
Febfast is a fundraising challenge encouraging participants to give up alcohol, or any vice of your choice, during February to raise funds for Lifeline Australia. All funds raised through Febfast will support Lifeline Australia’s services for people in crisis.
By registering for Febfast, you accept these Terms and Conditions and our Privacy Policy, and agree to comply with them.
2. Definitions
- “Event” refers to Febfast, a fundraising challenge held throughout the month of February.
- “We/Us” refers to Lifeline Australia ABN 84 081 031 263.
- “You/Participant” refers to any individual registered for Febfast.
3. Risk and Participation
- You acknowledge that participation in Febfast may involve personal or lifestyle challenges, including physical, mental, or social impacts resulting from changing my usual habits or behaviours.
- You declare that you are physically and mentally fit to take part in Febfast and have not been advised otherwise by a qualified health professional. You are solely responsible for managing your health and wellbeing during the challenge, including seeking medical advice or support if needed.
- You acknowledge that participation in Febfast may increase your exposure to contagious diseases, including but not limited to COVID-19, during any in-person fundraising activities or events.
- You agree to participate in Febfast entirely at your own risk and agree that Lifeline Australia is not responsible for any injury, illness, loss, or damage arising from my participation.
- To the maximum extent permitted by law, you release and indemnify Lifeline Australia from all liability, loss, damage, or claims (including negligence) arising from your participation in Febfast or any related fundraising activities.
- Nothing in this agreement is intended to limit or exclude your rights under the Competition and Consumer Act 2010 (Cth) or other applicable legislation, that are not permitted to be excluded or limited.

4. User Content
- By using the Febfast website and uploading content, you agree and consent to us using your submitted photograph(s), video(s), comment(s), and other materials (User Content) for advertising, marketing, promotional and related purposes in connection with Febfast and Lifeline Australia.
- By uploading User Content, you represent and warrant that:
- you own all rights in the User Content orotherwise have permission to submit it to us;
- the User Content does not infringe any third-party rights, including copyright, trademark, privacy, or publicity rights;
- the User Content is accurate, not misleading, defamatory, or obscene;
- any individuals identifiable in the User Content have given their consent for its submission and use by Lifeline Australia; and our use of the User Content as described does not require any further consent or payment to any third party.
- you own all rights in the User Content orotherwise have permission to submit it to us;
- You agree to indemnify Lifeline Australia against any losses, claims, or damages arising from your breach of this clause 4. You waive any rights or claims relating to our lawful use of the User Content, including claims for invasion of privacy, credit or attribution, or commercial use of likeness.
- We reserve the right to remove any User Content we deem inappropriate, and to restrict or terminate fundraising pages that breach these Terms. We will make reasonable efforts to consult with you before removing content from any team, individual, or community fundraising page.
5. Jurisdiction
- This Agreement is governed by the laws of New South Wales and the parties submit to the exclusive jurisdiction of the courts and tribunals of New South Wales in resolving any dispute in relation to your participation in, or support of, Febfast.
- Before resorting to legal action (other than urgent interlocutory relief), the parties agree to attempt to resolve any disputes in good faith by negotiation. If the parties are unable to resolve the dispute by negotiation within 10 business days of one party providing a written notice of dispute to the other party, either party may apply to the New South Wales Small Business Commissioner (SBC) for mediation of the dispute (link for reference: https://www.smallbusiness.nsw.gov.au/mediation). If that occurs and the dispute is not resolved by mediation within two months of application to the SBC, then the parties will be free to commence legal proceedings.
6. Participant Age
- I declare that I am over 18 years old and legally competent to agree to these Terms.
- I understand that I must be over 18 years old to participate in Febfast.
7. Authority to Fundraise
- By registering for Febfast, you are authorised to fundraise on behalf of Lifeline Australia, and you agree to conduct your fundraising in accordance with this authority.
- Any fundraising activity you undertake is your sole responsibility and must comply with applicable local, state, and federal laws.
- Lifeline Australia reserves the right to decline approval or withdraw authority for any fundraising activity that conflicts with Lifeline’s brand, values, or policies.
- Participants are responsible for covering any expenses related to their fundraising activities. Lifeline Australia will not be liable for these expenses.
- Lifeline Australia does not provide public liability insurance for third-party fundraising events. Organisers must obtain their own insurance if required.
- Lifeline Australia accepts no responsibility for accidents, injuries, or incidents occurring during the organisation or running of fundraising activities. Participants indemnify Lifeline Australia against any claims arising from such activities.
- It is the responsibility of participants to obtain any necessary permits, licences, or approvals from relevant authorities for their fundraising events.
- Lifeline Australia reserves the right to cancel or withdraw fundraising authority at any time if activities are deemed inappropriate or non-compliant.
